For each category of trade and for each country within the European Union, it is necessary to search published records for prior commercial use of each trademark or service mark so as to avoid possible trademark infringement.

European Trademark Registration

Geissler & Associates offers legal services in relation to the registration of trademarks in the European Union.

In Europe, the community trademark (CTM) system is administered by the Office of Harmonization in the Internal Market (OHIM) in accordance of the COUNCIL REGULATION (EC) No 40/94 of 20 December 1993 as amended.

European Trademark Fees

Separate fees are levied for each trade category and for each jurisdiction where registration is sought.  Typically, however, the costs per trademark or service mark inclusive of legal research, filing fees and professional fees, are as follows.

European Trademark – (OHIM)  $5,500
[NOTE: this represents $2,500 in professional fees plus $3,000 in statutory governmental filing fees and estimated costs such as foreign language translation.]

Slightly higher fees are charged for International Trademark Registration pursuant to the Madrid Agreement and Protocol.

Professional Fees

Geissler & Associates charges $240 per hour for all trademark-related legal services.
